For a period of twenty (20) years commencing from the date of completion set out above, Castle Metal Products (“CMP”) warrants to the Building Owner (“ Owner”) that, subject to the terms, conditions and limitations hereinafter stated, CMP will replace or repair that portion of the coping or gravel stop system (the”CMP System) that has failed due to a defect in CMP supplied materials in the CMP System at the above building, CMP's replacement or repair obligations over the life of this warranty being expressly limited to the Owner's original cost of the materials supplied by CMP for this CMP System.
TERMS, CONDITIONS, LIMITATIONS
1.) Owner shall provide CMP with written notice within thirty (30) days of the discovery of any CMP System failure. 2.) If inspection by CMP determines that the damage to the CMP System was caused by defective materials or by severe wind conditions not in excess of one hundred and ten (110) miles per hour (except as provided in paragraphs three (3) and four (4) herein), Owner's remedies and CMP's liability shall be limited to the replacement or repair of the damaged portion subject to the cost limitation set forth above. 3.) This Warranty shall not be applicable if, in the sole judgment of CMP, any of the following shall occur: A) The CMP System is damaged by wind in excess of ninety-five (95) miles per hour (Category 1 hurricane strength), or from flying debris, airborne objects, or natural disasters, including, but not limited to, tornadoes, earthquakes, lightning or fire. B) The failure is due to separation of the wood nailer substrate (or other approved attachment member) from the building. C) The CMP System is damaged by acts of negligence, accidents, misuse or abuse, including, but not limited to, vandalism, civil disobedience or acts of war. D) Metal work or other material not furnished by CMP is used in the CMP System. 4.) This Warranty shall be null and void if, in the sole judgment of CMP any of the following shall occur: A) Installing Contractor fails to install the CMP System in strict accordance with CMP's specifications and printed installation instructions , or B) if, after installation of the CMP System, there are any alterations or repairs made to the CMP System without first obtaining written authorization from CMP, or C) The Owner, Lessee, or other person responsible for maintaining the CMP Coping System fails to use reasonable care in maintaining that System, or D) Owner fails to comply with every term or condition stated herein. 5.) During the terms of this Warranty, CMP, its agents or employees, shall have free and reasonable access to the roof and CMP System during regular business hours. 6.) CMP shall have no obligation under this warranty until all bills for installation, supplies and service have been paid in full to the CMP System Installing Contractor, to metal suppliers, and to CMP. 7.) CMP's failure at any time to enforce any of the terms or conditions stated herein shell not be construed to be a waiver of such provision. 8.) This Warranty is given to the named Owner only and is not transferable. 9.) This Warranty supersedes and is in lieu of any and all other expressed warranties that are in conflict with the terms and conditions stated herein.

CASTLE METAL PRODUCT ASSUMES NO LIABILITY FOR, AND THE WARRANTY DOES NOT COVER, CONSEQUENTIAL DAMAGE OF ANY KIND WHICH RESULTS FROM ANY FAILURE OF, USE OR MISUSE OF THE WEATHER-LOC COPING SYSTEM OR THE PRESSURE-LOC SINGLE-PLY GRAVEL STOP SYSTEM. THIS IS THE ENTIRE WARRANTY AGREEMENT AND NO OTHER WARRANTY, EXPRESSED OR IMPLYED.
